• The Gift Scheme is operated by Mandap Samachar Patra and therefore this Agreement is between you and Mandap Samachar Patra. MandapZone.com is a website owned by Mandap Samachar Patra. Wherever the term "Mandap" is used in this document it represents the company Mandap Samachar Patra and the services provided through MandapZone.com.

• There is a registration fee to be paid by you for entering into the Gift Scheme.
• You will have to pay a renewal fee every year to keep your registration active.
• You may opt out of the Gift Scheme whenever you wish to do so.
• We are under no obligation to provide you with any particular number of gifts or any particular amount of money in place of gifts.
• We reserve the right to limit Gift Scheme enrolment at any time.

GIFT SCHEME DESCRIPTION

• We offer you participation in a Gift Scheme created for the promotion of Mandap Samachar Patra. After successful registration and account activation, your network is created and a “Sponsor ID” is assigned to you. You use this “Sponsor ID” to register new members to your network. New members are also added to your network when your direct parent or any of their direct parents add a member to their network and it is allocated to your network by the ‘auto-fill’ system. All members which are added by your child members are automatically part of your network. However, the scope of your network remains only up to 20 levels of child networks.
• You earn points whenever a member is added to your network.
• You earn bonus points whenever a member is added to the network using your Sponsor ID i.e. when the member is referred by you.
• You can redeem accumulated points for the available gift options. Refer to Redemption Policy for details.

TERMS OF PARTICIPATION

• You must be at least 18 years old to be a member or assisted by your guardian.
• You have to be able to understand English.
• You must agree to comply with all local, state, province, country or regional laws that may be applicable to your use of the Internet and your membership with Mandap.
• You MUST provide correct/true information about your profile. Mandap has the right to verify the information you provide. If this information changes you must immediately update your profile by logging in to MandapZone.com
• Corporations and other business entities are not eligible for the Gift Scheme.
• The use of any automatic tool to fill in forms, such as RoboForm, is forbidden.
• You agree not to abuse Gift Scheme privileges by conduct which is detrimental to the interests of Mandap Samachar Patra.
• By filling out the registration form you are applying to participate in the Gift Scheme. No employee-employer relationship is created by your use of the Mandap web site and its Gift Schemes. Mandap is under no obligation to offer its Gift Schemes to you.

MEMBERS CONDUCT

• You agree to only use the Gift Scheme in a manner that is consistent with the Terms and in such a way as to ensure compliance with all applicable laws and regulations.
• You shall ensure that your personal profile is up-to-date and accurate. You agree to promptly notify us of any change in your address (mail or email) or personal profile by updating your personal information at the Mandap Zone Web site.
• You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Gift Scheme, use of the Gift Scheme, or access to the Gift Scheme.

YOUR MANDAP ACCOUNT

• To create your account with Mandap, you will have to fill the registration form given on the Mandap Zone Web Site, read and accept the terms, conditions, and notices contained herein, without modification and make a payment of the designated amount, as mentioned on the registration form, to Mandap. Your account will be activated only after the realization of your payment of the designated amount.
• You are responsible for maintaining the confidentiality of your account and password. If you are under 18, you may use the website only with adequate involvement of a parent or guardian. We reserve the right to refuse access, terminate accounts, edit or remove content or cancel registration or redemption requests at the sole discretion of Mandap. YOUR MANDAP ACCOUNT VALIDITY
• The validity of your Mandap account is only 1 year (365 days) from the date of your Mandap account activation. After this period your account will be deactivated if not renewed by you. In order to continue using Mandap Zone Web Site and the offered Gift Scheme, you will have to renew your Mandap account by paying a renewal fee which is indicated on the Registration Form at the time of your registration. YOUR MANDAP ACCOUNT RENEWAL
• To continue using Mandap Zone Web Site and the offered Gift Scheme, your Mandap account must remain active. Once the validity of your account is expired, it is deactivated by our system. To keep your Mandap account active, you must renew your account by paying the stipulated renewal fee as mentioned on the Registration form at the time of your registration on the Mandap Zone Web Site.

MANDAP ACCOUNT BENEFITS

You are entitled to following benefits on the successful registration and account activation with Mandap as long as your Mandap account remains active -

• 1 Free membership of Mandap’s Matrimonial Web Site (www.Mandap.in).
• Free subscription to Madap’s monthly matrimonial newspaper, delivered to your address registered with us.
• Free bio-data publishing in the Mandap’s matrimonial newspaper – 3 times in a year.
• Free telephonic assistance in matchmaking, as per your need.
• Gifts, on point redemption, as per the Gift Scheme.

Point Redemption

• You can apply for redemption only when you have more than 500 balance points in your Mandap account and you have referred at least two members to the network (direct referrals). This limit is at the sole discretion of Mandap. Whenever it is changed, the information will be provided in the "Redemption" screen.
• If you opt out for a period of time, your earnings from your referrals and from new member addition to your network, will also be stopped for that period of time.
• Points can be redeemed only against available gift options. No monetary refund or redemption will be made for accumulated points.
• Mandap is not responsible for your taxes. You are solely responsible for the payment of taxes on the gifts received from Mandap.
• An administrative fee equivalent to the 20% of the Gift’s MRP will be charged and adjusted against your points being redeemed.
• We are under no obligation to provide you with any particular number of child members or any particular number of Gifts on point redemption.

TERMINATION OF MEMBERSHIP

• Mandap may terminate your membership at any time immediately with or without cause. Your right to use your membership immediately ceases upon termination. Mandap may terminate this agreement and your membership with or without prior notice. Termination of an account may lead to full or partial loss of the points accumulated prior to termination. On account termination, your points will be redeemed only if the minimum limit of 500 points has been earned. If the balance points are less than this limit at the point of account termination, you will not be entitled to redemption. Termination of an account is irreversible.
• You may cancel your membership at any time by contacting Mandap. Your participation will be cancelled and your points will be redeemed only if the minimum limit of 500 points has been earned. If the balance points are less than this limit at the point of account cancellation, you will not be entitled to this redemption. If you decide to cancel your account and later wish to re-enroll, you will be assigned a new account number and Sponsor ID. Any previous points made by yourself or through your referrals, that went unclaimed when you cancelled your account will not be credited to your new account should you re-enroll at Mandap. Cancellation of an account is irreversible.
• On cancellation or termination of your account, your profile will be removed from the site. Because of the way we maintain this Gift Scheme such deletion may not be immediate, and residual copies of your profile information may remain on backup media or Mandap database.
• You shall comply with all laws, rules, and regulations that are applicable to you. You acknowledge that you may only participate in the Gift Scheme if and to the extent that such participation is permitted by such laws, rules, and regulations. We may refuse to enroll you, or to restrict, modify, or terminate your participation in the Gift Scheme, without liability to you or any other party, if you violate any law, rule, or regulation, or if your participation in the Gift Scheme could violate any law, rule, or regulation.
• We reserve the right to terminate or disable, at our sole discretion, any Gift Scheme membership if we reasonably believe such Member has violated or acted inconsistently with the rules of the Gift Scheme or this Agreement. You understand and agree that disabling membership will result in your inability to redeem and/or earn Points. You understand and agree that termination of membership will result in the cancellation of all of your Points.

Mandap shall be the sole determiner in cases of suspected abuse, fraud, or violation of its rules and any decision it makes relating to termination of membership shall be final and binding. Should you object to any of the terms and conditions of this Agreement, or any subsequent modifications thereto, or become dissatisfied with the Gift Scheme, your only recourse is to immediately discontinue participation in the Gift Scheme and properly terminate your membership.

OUR PRIVACY POLICY

• We promise to maintain the privacy of your personal information. The full extent of our commitment can be found in our Privacy Statement. By enrolling and using the Gift Scheme, you agree to be bound by the terms of the Privacy Statement.

• You expressly understand and agree that:
• Your use of the Gift Scheme is at your sole risk. The Gift Scheme is provided on an "as is" and "as available" basis. Mandap and its subsidiaries, affiliates, officers, employees, agents, partners and licensors expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
• Mandap and its subsidiaries, affiliates, officers, employees, agents, partners and licensors make no warranty that (i) the Gift Scheme will meet your requirements; (ii) the Gift Scheme will be uninterrupted, timely, secure or error-free; (iii) the results that may be obtained from the use of the Gift Scheme will be accurate or reliable; (iv) the quality of any products, Gift Schemes, information or other material purchased or obtained by you through the Gift Scheme or through the Gift Scheme advertisers or partners will meet your expectations; and (v) any errors in the software will be corrected.
• Any material downloaded or otherwise obtained through the use of the Gift Scheme is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
• No advice or information, whether oral or written, obtained by you from Mandap or through or from the Gift Scheme shall create any warranty not expressly stated in the terms of use.
• A small percentage of users may experience epileptic seizures when exposed to certain light patterns or backgrounds on a computer screen or while using the Gift Scheme. Certain conditions may induce previously undetected epileptic symptoms even in users who have no history of prior seizures or epilepsy. If you, or anyone in your family, have an epileptic condition, consult your physician prior to using the Gift Scheme. Immediately discontinue use of the Gift Scheme and consult your physician if you experience any of the following symptoms while using the Gift Scheme: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.

LIMITATION OF LIABILITY

• Mandap Samachar Patra shall not be liable for any special indirect, punitive, incidental, special, or consequential damages relating to the participation or inability to participate in the Gift Scheme.
• Mandap Samachar Patra is not responsible for damages or losses that result from participating or inability to participate in the Gift Scheme, or reliance on or use of information, Gift Schemes, or merchandise provided on or through the Gift Scheme.
• You acknowledge and agree that Mandap Samachar Patra neither endorses the contents of advertisements or third parties' web sites, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third party intellectual property rights arising there from, or any fraud or other crime facilitated thereby.
• To the maximum extent allowed by applicable law, neither Mandap nor any of its parents, members, subsidiaries, Gift Scheme providers, licensors, officers, directors or employees shall be liable for any direct, indirect, incidental, special or consequential damages arising out of or relating to this agreement, resulting from the use or the inability to use the Gift Scheme or for the cost of procurement of substitute goods and Gift Schemes or resulting from any goods or Gift Schemes purchased or obtained or messages received or transactions entered into through the Gift Scheme or resulting from unauthorized access to or alteration of user's transmissions or data, including but not limited to, damages for loss of profits, use, data or other intangible, even if such party has been advised of the possibility of such damages. Without limiting the foregoing, everything on the site is provided to you "as is" without warranty of any kind, either expressed or implied including, but not limited to, the implied warranties of Gift Schemes, merchantability, fitness for a particular purpose, or non-infringement. Mandap disclaims all liability, regardless of the form of action, for the act of other members, or users including unauthorized users, or hackers of the Gift Scheme.

PARTICIPATION IN PROMOTIONS OF ADVERTISERS AND PARTNERS

• Your correspondence with or participation in promotions of Gift Scheme advertisers and partners, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the advertiser or partner. We assume no liability, obligation, or responsibility for any part of any such correspondence or promotion, including without limitation withdrawal or modification of any offer or promotion.

ACCOUNT TRANSFERABILITY

• You are not allowed to share your account with any other individual. Nor are you allowed to transfer accounts to someone else.
• In the event of your death, your membership will be transferred to the Nominee, which you have specified in the registration form.

COPYRIGHT

• All content on this website not limited to but including text, graphics, logos, icons, images, audio clips, data and software is the property of Mandap or its associates and protect Indian and International copyright laws. All software used on this website is the property of Mandap and protected by the Indian and International copyright laws.
• Except as expressly authorized by Mandap or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Gift Scheme or the Software, in whole or in part.

TRADEMARKS

Trademarks of Mandap should not be used without prior written consent or permission. Trademarks not owned by Mandap that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to or sponsored by Mandap.

MODIFICATIONS

• Mandap reserves the right to change this Terms and Conditions document. Current members will be informed by email, however it is also your responsibility to check this document periodically for any changes or modifications and you must not rely on e-mails as a sole source of information regarding this agreement or your membership. Your continued use of Mandap constitutes an affirmative acknowledgement by you of the Terms and Conditions and any subsequent modifications made to it and your agreement to abide and be bound by the Terms and Conditions document in its modified form.
• We reserve the right to modify or discontinue the Gift Scheme with or without notice to you. We shall not be liable to you or any third party should we exercise our right to modify or discontinue the Gift Scheme.

ELECTRONIC CONTRACTING AND NOTICES

• Your affirmative act of registering for any Service constitutes your electronic signature to these Terms and Conditions of use of the website or service and your consent to enter into agreements with us electronically. You also agree that we may send to you in electronic form any privacy or other notices, disclosures, documents or communications regarding the services.

INDEMNIFICATION

• You agree to indemnify and hold us, our affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim, demand, expense, or damage, (including reasonable legal fees) made by any third party due to or arising out of your use of the Gift Scheme, your connection to the Gift Scheme, your violation of the Terms, content you submit, post to or transmit through the Gift Scheme or your violation of any rights of another.

GENERAL

To the maximum extent permitted by law, this agreement is governed by Indian Laws and you hereby consent to the exclusive jurisdiction and venue of courts in Jabalpur, Madhya Pradesh, India, in all disputes arising out of or relating to the use of the Mandap Zone Web Site. Use of the Mandap Zone Web Site is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Mandap Samachar Patra as a result of this agreement or use of the Mandap Zone Web Site. Mandap Samachar Patra's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Mandap Samachar Patra's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Mandap Zone Web Site or information provided to or gathered by Mandap Samachar Patra with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Mandap Samachar Patra with respect to the Mandap Zone Web Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Mandap Samachar Patra with respect to the Mandap Zone Web Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
